1. General
These Terms of Service constitute an agreement between you and National Personal Training Association (NPTA). By using the NPTA website, you agree to be bound by the terms herein, along with any specific payment agreements you make on the site. Any stipulations of these Terms of Service that are deemed unenforceable do not invalidate this agreement entirely, but shall only be limited to those specifics which, by modification or elimination, may allow the rest of the provisions to remain intact.
2. Disputes Subject to Arbitration
Users of this site agree that any disputes are subject to binding arbitration at the sole discretion of NPTA and in a venue and manner convenient to NPTA, regardless of the location of the disputant. In any case, remedies are limited to the amount of fees for services actually collected by NPTA in the six-months prior to any claim being made.
3. Refunds
NPTA offers a 100% Money Back Guarantee as long as the final exam has not been taken. If for whatever reason you are not satisfied with our program, please simply email us and we will refund 100% of your fees to your credit card, as long as the final exam has not been completed and certification granted. If you are concerned with acceptance, we recommend checking with your employer first prior to registering for our course. Every employer has different requirements and we cannot guarantee acceptance for this reason. Our programs are not accredited, and if this is an issue, please find an alternative program.
4. Certifications Offered
NPTA certification is not meant to replace the educational requirements of a fitness professional. The role of personal trainer is varied and may entail the risk of physical/emotional harm to clients of personal trainers. NPTA does not, nor can it, regulate the practice of any personal trainer, nor does NPTA offer the requisite training for those who are either employed as a physical trainer, nor those who sell services to the public directly. It is your responsibility to know any and all laws pertaining to your practice in your locality, in both the type and extent of services offered. NPTA makes no warranty regarding the applicability of material presented to any particular career path or services offered.
NPTA recommends, and you agree, that personal trainers obtain a letter of consent from the personal physician for all clients, without regard to appearance of health status, and prior to any services being offered by you. You further understand that to participate in our site, you must be at least 18 years old and must complete an in-person practicum or internship with a qualified personal trainer, consisting of a minimum of 25 hours, before acting without supervision, and that you will pursue and maintain continuing education requirements as well as obtaining liability insurance appropriate to your activities as a personal trainer.
For water aerobics certification, you understand that a lifeguard/rescue swimming certification must be obtained separately, before offering any services in water aerobics.
5. Privacy Policy
Our privacy policy describes the information we collect and how we use it. You should periodically review the policy. Your use of our site constitutes your agreement to the terms of the privacy policy. Please contact us if you have any questions or concerns.
6. Copyrighted Materials
The instructional materials provided by NPTA are for the sole and exclusive use of those who have paid for access. However, use of the materials is licensed only for the period and for the person who has purchased the services. NPTA retains sole and exclusive ownership and copyright to all materials on our site, and you agree not to copy or share instructional materials with others. We may, at our discretion, offer samples or discounted materials, even without payment. However, doing so does not impair any ownership rights or alter the value of materials at the time, price and manner they have been offered previously. NPTA ownership rights extend to all applicable content, including graphics (line and photographs), text, and software.
7. No Warranty Offered
Nothing in this Terms of Service, nor on the website, should be construed to be a warranty of any type whatsoever. We make no representation as to the accuracy, nor completeness of the materials on this site, and you agree to hold NPTA harmless for any errors in the delivery of services or the information provided. You understand that continued use of this site is at your own risk and any content found on the site is not meant to be authoritative in any fashion. You agree that any use of the information and content by you will be based entirely on your own judgement and NPTA will not be liable for any damages, harms, or losses that result from such judgement.
8. Further Limitations
You agree that certifications issued by NPTA do not constitute an assessment of actual skill or training and should not be relied upon by employers or individuals as evidence of qualifications. Any misrepresentation of our certifications constitutes fraud and you agree that no liability whatsoever will extend to NPTA, its employees, principles, or shareholders for any such use of the certification. Furthermore, any mention of other products and services by NPTA does not constitute an endorsement of such items or services. Refunds are not granted after a period of 6 months.
9. Indemnification
You agree to indemnify and hold NPTA, its affiliates and partners, harmless from any and all claims or demands associated with any services or products offered on our website, including any malicious software, misinformation, insufficient information, or anything related to NPTA and its affiliates. Should you attempt to raise a claim, you understand you will be responsible for any costs to NPTA, including attorney fees, arbitration costs, judgements, and any associated business expenses.
